1. Acceptance of Terms

By creating an account or using Whistle at whistlerules.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Whistle is an educational study tool for NCAA college football officials. The Service provides AI-generated and rules-engine-based quiz questions, a rules reference library, performance analytics, and study tracking to help officials learn and retain football rules knowledge. The Service is intended for educational purposes only and is not affiliated with or endorsed by the NCAA.

3. Accounts

You must create an account to use Whistle. You are responsible for maintaining the confidentiality of your password and account. You agree to provide accurate and complete information when creating your account and to keep that information up to date. You must be at least 13 years old to use the Service. You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free Trial and Subscription

Free Trial

New accounts receive a 14-day free trial with full access to the Service. No payment information is required to start the trial. At the end of the trial period, you will need to subscribe to continue using the Service.

Subscription Plans

Whistle offers monthly ($9.99/month) and yearly ($99.99/year) subscription plans. Subscriptions are billed in advance on a recurring basis. You can view current pricing on our Pricing page.

Cancellation

You may cancel your subscription at any time through the billing section of your account. Upon cancellation, you will retain access until the end of your current billing period. No refunds are issued for partial billing periods.

Payment Processing

All payments are processed securely by Stripe. Whistle does not store your credit card or banking information. By subscribing, you also agree to Stripe's Terms of Service.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to attempt to gain unauthorized access to any part of the Service or its systems, use the Service to distribute malware or engage in any harmful activity, share your account credentials with others or allow multiple people to use a single account, scrape, copy, or redistribute the quiz content, rules database, or other proprietary materials, interfere with or disrupt the Service or its infrastructure, or use automated tools or bots to access the Service without our express permission.

6. Intellectual Property

The Service, including its design, features, quiz content, and software, is owned by Whistleand protected by intellectual property laws. NCAA football rules are published by the NCAA and are referenced here for educational purposes. AI-generated quiz questions are created for your personal study use and may not be reproduced or distributed commercially. You retain ownership of any feedback or suggestions you submit, but grant us a license to use that feedback to improve the Service.

7. AI-Generated Content

Whistle uses artificial intelligence to generate quiz questions and study materials. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. The Service should be used as a supplementary study tool and not as the sole source of rules knowledge. We encourage users to report any inaccuracies through our feedback system so we can continuously improve question quality. Whistle is not responsible for any consequences arising from reliance on AI-generated content.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee that quiz content will be 100% accurate or up to date with the latest NCAA rule changes. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, Whistle and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Any data associated with your account will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration.
